Terms of Service
These terms apply when you buy a website, hosting, email, CRM or booking plan from Start My Tradie. By paying a setup fee you agree to them.
1. What we provide
We build and maintain a website for your business and configure the associated services described in your chosen plan — which may include domain connection, hosting, SSL, business email, CRM, online booking, analytics and SEO setup. Exactly what's included depends on the plan you select at signup.
2. Fees and billing
- The setup fee is a one-off charge, payable before work begins.
- The monthly fee starts on the day your site goes live and is billed monthly in advance.
- All prices are in Australian dollars and exclude GST unless stated otherwise.
- Work outside your plan is quoted and approved by you in writing before it starts.
- We may change our pricing with 30 days written notice. Existing customers keep their rate for at least 12 months from signup.
3. What we need from you
To build your site we need your business details, service list, service area, contact details and any logos or photos you want used. If we don't hear back from you for 30 days during a build, we may pause the project and resume it when you're ready.
You confirm that any content, images or logos you supply are yours to use and don't infringe anyone else's rights.
4. Ownership
You own your domain name, your content, your images and your customer data. We retain ownership of the underlying templates, code frameworks and tooling we use across all customers. On cancellation we will provide an export of your website content and CRM data.
5. Cancellation
There is no lock-in contract. Either party may cancel with 30 days written notice. Setup fees are non-refundable once work has commenced. Monthly fees already paid are not refunded for the remainder of the current period.
If your account is more than 30 days overdue we may suspend services after giving you written notice.
6. Uptime and support
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance is performed outside business hours wherever possible. Support requests are answered within one business day, Monday to Friday, 8:30am to 5:30pm AEST.
7. SEO and results
We build your website using search engine optimisation best practices. We do not guarantee search rankings, traffic volumes, enquiry numbers or revenue. Search engines control their own results and change their systems without notice.
8. Acceptable use
You may not use our services to publish unlawful, misleading, defamatory or infringing content, to send unsolicited bulk email, or to operate anything that breaches Australian law. We may suspend services immediately if you do.
9. Liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. To the extent permitted by law, our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential loss including lost profits or lost business opportunities.
10. Changes to these terms
We may update these terms. Material changes will be emailed to active customers at least 30 days before they take effect. Continuing to use the service after that date means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
